REMANDED FOR STABBING MAN TO DEATH

A Benin High Court, Criminal Division sitting in Benin City has remanded one 27 years old Iyare Olaye in the custody of the Edo State Police Command alleged murder charge.

The Defendant had on 22nd June 2020 at No. 5 Iguisi street off Ibiwe street, Benin City, murdered one Ahmed Yekini whom he had a quarrel with.

It was alleged by the Prosecution that Iyare attacked the late Ahmed with a knife and stabbed him on the neck which led to his be death.

SUSPECTED CULTISTS REMANDED FOR ALLEGED MURDER

Six persons who allegedly murdered a young man in Benin City on children’s day have been remanded in Police custody by a Benin High Court, Criminal Division, sitting in Benin City.

The Defendants; Jabi Osula(29), Ikechukwu Amah(20), Omon Oyen(22), Bidemi Obafemi(29), Osagiede Kelvin (20) and Oziegbe Egharevba(19), were alleged on the charge sheet to have According to the charge sheet, conspired with others now at large, on 27th May 2020, to murder one Christopher Ekhomu with a cut-to-size single barrel gun.

They allegedly trailed the victim to Sun Gas at upper Mission Road in Benin City, were they shot him with a him on be his neck which led to his death.

The Defendants were alleged belong to a secret cult group, an offence punishable under relevant sections of the law.

They also allegedly had in their possession a cut-to-size single barrel gun and three live cartridges which they carried without lawful authority and valid license.

The court, having heard the application of the Prosecution, accordingly remanded them in the custody of the Edo State Police Command and ordered that their case file be duplicated and forwarded to the office of the state Director of Public Prosecutions (DPP), for legal advice

BROTHERS, FRIEND REMANDED FOR ARMED ROBBERY

Two brothers; Osaherhunmwen(34) and Stephen Enehikhare(22) as well as their 31 years old friend, James Okhuarobo, have been remanded in Police custody on the orders of a Benin High Court, Criminal Division, sitting in Benin City for alleged armed robbery related charges.

They were alleged to have on 15th June 2020 at Ugbogun village, along Benin/Auchi road robbed some travellers of their properties and various cash sums.

The Defendants and others now at large allegedly robbed one Felicia of the sum of ten thousand naira and clothes worth five hundred naira.

It was the contention of the Prosecution on the charge sheet that the Defendants also robbed another victim identified as Michael of his personal effects and a cash sum of one hundred and twenty three thousand naira.

Further more, they also allegedly robbed one Felix of the sum of two point five million naira and another Faith of assorted drinks and clothes worth two hundred and fifty thousand naira.

According to the Prosecution, the Defendants who were armed with locally made guns shot sporadically into the air while the robbery operation lasted, an offence punishable under relevant sections of the Armed Robbery and Firearms (special provision) Act, 2004.

HUSBAND AND WIFE REMANDED FOR POISONING SON TO DEATH

One 51 year old Isaac Uweniyi and his 30 years old wife, Elizabeth Uweniyi, have been remanded in custody for alleged conspiracy and murder of their son.

They were alleged in the two-count charge slammed on them to have poisoned a plate of rice which the served their 19 years old son, marvis, to eat which led to his death.

The offence as stated on the charge sheet, was allegedly committed on 3rd June 2020 at Egbeta village in Ovia North East Local Government Area of Edo State.

Presiding Judge of the Benin High Court, Criminal Division, sitting in Benin City, accordingly made their remand order while directing that their case file be duplicated and forwarded to the office of the state Director of Public Prosecutions(DPP), for legal advice.

A BENIN MAN CAN ONLY HAVE ONE IGIOGBE

The court of appeal sitting in Benin City has declared house No. 102 Lagos street, Benin City, as the Igiogbe of the late Mr. Alfred Omoregie Odiase.

Delivering judgment in the matter filed before the court in the year 2002, the lead Judge, Hon. Justice Helen Moronkeji Ogunwumiju, held that the house belongs to the 1st Respondent, Mr. Henry Omoregie, being the eldest surviving son of his late father, Mr. Alfred Omoregie Odiase who died on 11th August 1993 in Benin City.

The court, declared that the semi detached building also belongs to the 1st Respondent without any encumbrances, emphasizing that any bequest of shops etc, to any other beneficiary made by the late man via a WILL was void.

Hon. Justice Ogunwumiju, however, declared that all the bequests in respect of the separate house No. 102B, Lagos street, Benin City, is not part of the Igiogbe being a separate house on the land is valid.

It was further held by the court that the 1st Respondent is not entitled to any other part of the houses, land or shops at No. 41B, now 81B New Lagos road, Benin City.

The court noted that the claim at the trial court and the counter claim indicates that both parties agreed that the Igiogbe is the ancestral home of the deceased at 102 Lagos street.

Making recourse to a Supreme Court judgment, Hon. Justice Ogunwumiju held “under Benin Native Law and Custom, Igiogbe means a principal house where a deceased Benin Man lived and died; the right to inherit and possess such property vested only in the eldest son. The tradition takes precedent over and above the wishes of a deceased father no matter how strong he feels against his son as the prospective heir . It is a right vested in the eldest son and cannot be divested by means of disinheritance.”

The Appellants in the case are; Mr. Omoregie Asaolu, Anthony Edosomwan, Ikponmwosa Odiase, Mrs. Orobosa Atu (Nee Omoregie), Mrs osayomore (Nee Omoregie), Gumwendia Omoregie, mrs Eghianruwa Osagiede (Nee Omoregie) Etinosa Omoregie and Oghogho Omoregie.

COURT KNOCKS EDO GOVT. OVER ILLEGAL RETIREMENT OF PERMANENT SECRETARY

The National Industrial Court sitting in Benin City has declared as null and void, the retirement directive issued by the Edo State government handed over to one Mrs. Caroline Edo-Osagie, during the Adams Oshiomhole’s administration in 2013.

In his judgment, presiding Judge, Hon. Justice A.A. Adewemimo, held that the Claimant’s sudden removal from office as a Permanent Secretary was unconstitutional, illegal, null and void and of no effect.

The court also held that the Claimant was removed from office for lack of due process and without giving her right to fair hearing.

The court consequently set aside the purported retirement letter dated 30th April 2013 issued to Mrs. Edo-Osagie by the Edo State government while the suit was pending before the court, an action the court declared as unconstitutional, illegal and a breach of her condition of service.

Hon. Justice Adewemimo who held that the Claimant was appointed a Permanent Secretary in Edo State effective 30th March 2008 and was published in the Edo State Gazette No.14V of 23 March 2008 as Legal Notice No. 22, noted with dismay the manner she was removed from office without any lawful justification.

Hon. Justice Adewemimo ordered the Edo State government to pay Mrs. Edo-Osagie her salaries as permanent secretary with effect from 17th August 2012 to 14th August 2013.

The Edo State government was also ordered by the court to pay the Claimant her furniture allowance as well her pension per month with effect from 31st August 2013 till the date of the judgment.

EDO ENFORCEMENT OFFICER CRUSHED TO DEATH

Tragedy struck at Ring Road, Benin City, when a moving, car crushed an enforcement officer to death. The victim identified as Tony, who was dressed in black T-shirt and a pair of black jeans trousers, is believed to be a member of the Edo State Public Works Volunteer (PUWOV), was trying to arrest a traffic violator when the incident occurred. It was gathered that on seeing a commercial bus picking up passengers at an unauthorized portion of the Ring Road, Tony in a bid to catch the offender, ran to the middle of the road, held the door to jump into the bus, but the conductor pushed him down. Further investigation revealed that Tony fell down flat on road where an oncoming car rammed across his head leaving him dead while the car sped away. The development which drew large crowd of sympathizers caused heavy traffic on the road. Efforts to get comments from chairman of the PUWOV, Mr. Murktari Osagie was unsuccessful.

OBASEKI EMERGES CONSENSUS CANDIDATE FOR PDP

Edo State Governor, Godwin Nogheghase Obaseki has emerged the consensus candidate for the Peoples Democratic Party ahead of the 19th September 2020 Governorship election in Edo State. Other aspirants; Engr. Gideon Ikhine, Omoregie Ogbeide-Ihama and Kenneth Imasuagbon, announced their intention to step down for Mr. Godwin Nogheghase Obaseki at the Samuel Ogbemudia stadium, venue of the Party’s primary election.

COURT SAYS OBASEKI CAN CONTEST PDP PRIMARY ELECTION

A Federal High Court sitting in Port Harcourt, Rivers State, has struck out the suit filed by Omoregie Ogbeide-Ihama aimed at stopping Governor Godwin obaseki from contesting the Edo State primary election of the Peoples Democratic Party slated for 25th June 2020. Earlier in the day, D.C. Denigwe SAN, who is Counsel to Ogbeide-Ihama, prayed the court for a stand down to enable the parties to the suit meet and resolve the matter out of court, an application the court granted. At the resumed hearing of the matter, few hours later, Denigwe SAN, informed the court that the Disputants have settled and prayed for withdrawal of the matter from the court. On their part, Higher King who is Counsel to Uche Secondus, the 1st Defendant and 2nd-7th Defendants, as well as that of the 8th and 9th Defendants, Alex Ejesiema, aligned with Denigwe SAN. Ruling on the matter, presiding Judge, Hon. Justice E.O. Obile according struck out the matter and commended the parties for resolving the matter out of court, which according to him, was the proper thing to do.

EKPOMA HIGH COURT RESTRAINS PDP, FOUR OTHERS FROM BARRING OBASEKI FROM PRIMARY

An Ekpoma High Court has restrained the Peoples Democratic Party, Edo State PDP Chairman, Dr. Tony Aziegbemi, Hon Andy Ikhajiangbe, Peter Akhimien and the Independent National Electoral Commission from excluding or purportedly to exclude or prevent any of the aspirants cleared by the party to participate in the primary election billed for 25th June 2020. The cleared aspirants are; Governor Godwin Nogheghase Obaseki, Kenneth Imasuagbon, Omoregie Ogbeide-Ihama and Gideon Ikhine. court also restrained the Defendants from removing the names of the Claimants, Felix Irioh and Tony Irehobhude who are statutory delegates from the list of delegates to participate as voters in the Party’s primary election aimed at electing or selecting the Party’s candidate for the Edo State Governorship election slated for 19th September 2020, pending the determination of motion on notice for interlocutory injunction. Granting the order of interim injunction, presiding Judge, Hon. Justice Joy Okeaya-inneh, held that the Claimants Applicants have satisfied the guidelines for the grant of the order sought as enjoined in the celebrated case of KOTEYE vs. CBN 1989 1, NWLR PT. 98, 419 at 441. The noted that there was no undue delay in bringing the application. Hon. Justice Okeaya-inneh also ordered that hearing notices be issued/served on the on the 1st to 5th Defendants Respondents. The case with suit number HEK/125/2020 was consequently adjourned to 1st July 2020 for hearing of pending application.
